FDA Cracks Down on LapBand Ads They Say Are Misleading
If you live in the Southern California area, then you no doubt have seen 1-800-GET-THIN billboards and advertisements promoting the LapBand surgical procedure that purports to help an individual lose weight. Well, so did the Food and Drug Administration, who took issue with the ads, saying that they were misleading. They sent the company behind the ads a letter in December telling them the things they would need to do to make their ads compliant with FDA standards, and in January, the ad company submitted a list of potential corrections.
The FDA has now said that these corrections were not sufficient. In a new letter, the agency has said that, among other things, the ads must include a statement that says getting the LapBand surgery may result in injury or death. The marketing team behind the ads has been ordered by the FDA to take down all ads immediately. If they don’t comply, then they could be in danger of having products seized, facing injunctive action, or incurring financial penalties.
The FDA’s new stipulations concern ads across television, radio, and the internet, as well as billboards. The marketing campaign team has said that they have canceled all broadcast and print advertising and that they will work with officials to ensure that any new ads follow set guidelines.
